H1B Approval after RFE

Monday, October 26th, 2009

We recently received word from an attorney that another client’s RFE had been successfully answered. This client had a four year Bachelor Degree, along with work experience in the field of the labor certificate. The previous evaluation had been completed by another foreign credential evaluation agency.
The RFE requested more information about the client’s work experience and required demonstration that the client’s bachelor degree and work experience resulted in qualification for the labor certificate as it had been issued. Rather than re-evaluating the Bachelor Degree, we chose a different route – that of closely examining both the education and the combined work experience.
We demonstrated that the client had sufficient work experience, along with an accredited four year Bachelor Degree, to show an educational major in the field of the labor certificate. The USCIS responded by accepting the answer, and approving the client’s H1B visa.

EB3 Approval after NOID

Saturday, October 17th, 2009

This week, a client notified us of a letter from USCIS approving her EB3 (I-140) Visa after having previously received a denial letter in response to an educational evaluation completed by a different credential evaluation agency. She had a three year Bachelor Degree from India, but the USCIS denied her Visa on the grounds that a 3-year Bachelor Degree is not equivalent to a USC four-year Bachelor Degree.
Using extensive documentation and research developed by Dr. Danzig and Professor Kersey over the last several years, CCI was able to present sufficient evidence, as well as a detailed evaluation and expert opinion letter, clearly demonstrating the client’s degree as equivalent to a US four-year Bachelor Degree.
Because she obtained a degree in a related field, but her major was not in that specified by the labor certificate, we were able to use a functional equivalency process to demonstrate that she had the necessary education to meet the labor requirement. USCIS responded to our evaluation and expert letter by approving the client’s I-140 visa.

H1B Approval After “Nightmare” RFE

Friday, October 9th, 2009

Two weeks ago, we received word from an attorney that another H1B RFE had been successfully answered, and the client’s case had been approved. The client had submitted her credentials for a nursing degree, as well as an evaluation from another agency, and USCIS found cause to issue an RFE – a request for information.
With an expert onion letter and an evaluation, Dr. Danzig and Professor Kersey were able to offer the client’s attorney evidence that the client did indeed have the required credentials. The Bachelor’s Degree was demonstrated as equivalent to a US Bachelor Degree in Nursing, and the attorney went on to answer the other queries submitted by USCIS in the brief.
This year, many clients have submitted RFEs from USCIS that are difficult and challenging to answer. Attorneys with whom the agency works have also indicated receiving a higher number of these difficult RFEs this year than in years past. Responses from our clients and their attorneys, though, have indicated we’ve been able to help the vast majority of those persons for whom we have issued evaluations.
